1. Introduction

Welcome to PassTier Core, a SaaS platform provided by ODX Health, LLC. By accessing or using our services, you agree to these Terms of Service. If you do not agree with any part of these Terms, please do not use the service.

2. Eligibility & Account Registration

Users must be licensed professionals or students actively engaged in anesthesiology training. You must be (a) at least 18 years old and (b) legally able to enter this Agreement. You are responsible for maintaining the confidentiality of your account and ensuring all activities under your account comply with these Terms.

3. License Grant & Limitations

Subject to your acceptance of these Terms, ODX Health, LLC grants you a limited, non-exclusive, non-transferable license to access and use PassTier Core solely for your internal business or educational purposes. You agree not to employ any automated means to access our services or gather any proprietary or confidential information.

4. Intended Use & Platform Limitations

PassTier CORE is designed for standard educational use in anesthesiology oral board preparation. The platform is optimized for normal, typical transcript analysis workflows and educational assessment scenarios.

Non-Intended Uses: PassTier CORE is not designed for, and users should avoid:

• Edge case testing or experimental use beyond standard educational assessment
• High-volume case loading or stress testing of the platform
• Unorthodox or non-standard applications outside oral board preparation
• Automated or bulk processing beyond normal individual use patterns
• Any use that deviates significantly from typical educational assessment workflows

Users acknowledge that optimal platform performance and accuracy are achieved through normal, intended use patterns. Deviation from standard use cases may result in suboptimal results or service limitations.

5. Prohibited Uses

Users shall not use the platform to:

• Violate any law or regulation
• Reverse engineer, decompile, or otherwise attempt to discover any source code or underlying ideas related to our proprietary algorithms
• Upload or distribute any content that infringes upon third-party rights
• Upload PHI without a Business Associate Agreement
• Use the Services for patient‑care decisions or other high‑stakes purposes
• Interfere with security or normal operation

6. Intellectual Property & Proprietary Methods Protection

PassTier Core's computational scoring engine, including all underlying algorithms, methodologies, models, and processes, is the exclusive and proprietary property of ODX Health, LLC. No user, licensee, or third party is permitted to:

• Reverse engineer, decompile, or otherwise attempt to derive the source code underlying the scoring engine
• Disclose, publish, or disseminate any details or elements of the algorithms or methodology
• Use any output or process to reconstruct or replicate the proprietary processes

Any unauthorized attempt to access or deduce the inner workings of our algorithms shall result in immediate termination of access and may subject the offender to legal action.
